What is emerging from the PNU after the stand-off last Friday is that they over-estimated their powers under the new constitutional regime. When Kibaki basically tried ordering Raila to accept his commands and give him the list of cabinet appointees or else..., they had no plans and no idea on what to do if Raila and the ODM told them to take a hike. Well that is what happened. The ODM told them to go a head and name their cabinet and worse still for PNU, the ODM suspended any more participation in the circus that the talks had become and gave their conditions for coming back to the table. In general the public and the international community have been outraged by PNU and their attempts to horde power.
Instantly PNU realized they had no plan B. They could not even pretend to be having those charade of meetings and consultations at Harambee House without the other side. So they did their solo meeting on Monday and Kalonzo came up with bizarre statements which just tells you how confused they are.
First Kalonzo indicated they were ready for fresh elections. I can bet my mom's goat that is a position nobody in PNU had even thought about clearly. It was more intended to intimidate the ODM that if they continue pushing they could very well face fresh elections since the president has the power to dissolve parliament and send the country to the polls.
Remember before Kalonzo made these statements PNU held a meeting in which some of the hardliners with no respect for the Accord tried to urge Kibaki to appoint his half of the cabinet anyway. Eventually Kibaki had to succumb to the reality that he did not have such powers of arbitrarily naming a cabinet. Kibaki then gave a thirty second press conference in which he said nothing.
From there on PNU realized the pickings are slim for them. The pressure is coming from everywhere for the them to be honest about the Accord. On their own there is nothing they can do. Kibaki got tired of meeting his "cabinet" and resorted to just meeting Kimunya may be to work out on the cash side of the treachery.
To muddy the waters PNU somehow leaks this fake list of ministries, something Kalonzo had hinted to in his "ready for election" speech. The idea here once again is to intimidate ODM by hinting to them that Kibaki could go for such a small cabinet that ODM would not have space for some of their big guns.
The ODM's response on both counts was swift and firm. In a press conference addressed by Ababu Namwamba and others ODM indicated they are even more ready for elections and in fact they think it is the way to go. On the cabinet size the ODM reminded PNU that in their own manifesto they had proposed a cabinet of twenty five and they will readily accept a cabinet of twenty and take their ten. Of course the PNU in their mischief according to the Standard story had already arrogantly allocated themselves the ministries something they cannot do by themselves unless they don't even understand why they are in a stalemate.
What emerges here is a PNU shooting blanks in the dark with no clue what to do next and an ODM that is not willing to budge one inch unless things are done right. As we know Kibaki hates pressure, but we also know nothing works with him unless he is cornered. We all know how we ended up with Kibaki signing the Annan deal.
I think elections is the way to go but all indications are Kibaki is going to succumb to reality. All the mind games Kalonzo and co are trying just makes things worse for them. If PNU proposes 20 cabinet positions which means Kibaki firing seven of his 17 cabinet members, how are they going to go back and demand 40 again without looking completely foolish. 10 cabinet positions will just plainly kill Kibaki but it would be ideal for Kenya so yeah, bring it on.
Bottom line is the country cannot operate under the present stalemate. There are a few confused fellas who think Kibaki can just sit there forever. No, sir, that is unworkable. When Kibaki signed the NARA, he should have figured what he was signing. The imperial presidency is history and the sooner Kibaki understands that the better for him and the for the country. Yes, the president is still the head of state and head of government but his responsibilities and authority as head of government are greatly tampered with and reduced by the NARA. Kibaki has to deal with that reality.
That camel Michuki talked about does not just have its head inside the tent as he alleged, it is all in there and there is enough space to accomodate the gentle animal in the tent if things are re-arranged. There could even be harmony if the present inhabitants of the tent learn to live with the camel. Otherwise there will be no tent to speak of, since the camel knows it is its tent to begin with.
Kibaki's only alternative is to withdraw from the Accord and let the chips fall where they may. He can't do that because it may very well mark a very abrupt end to his political life in circumstances that may be very injurious to the nation.
The ODM on the other hand are in no hurry to do anything. They can just sit back and watch Kibaki twist in the dark. All they have to do is to calm their supporters and the country down as they wait. From reports around the whole country people are more than ready to take Kibaki on. The ODM's job is going to be to get things done in an organized and peaceful way. Even the cops are tired.
As for the IDPs there is not a single politician in both sides interested in addressing their plight. That is a real shame. I will talk about that later.
